A grand jury has declined to bring charges against the man accused in a shooting at Kentucky State University that resulted in the death of a student.
Jacob Lee Bard will not face prosecution for murder or assault after the grand jury determined there was insufficient basis to issue an indictment. The decision effectively ends the criminal case against him.
Bard had maintained that he acted in self-defense when he fatally shot 19-year-old De’Jon Darrell Fox Jr. and wounded another student during the December 9 incident. His attorneys argued that Kentucky law allows the use of deadly force when a person reasonably believes it is necessary to protect themselves or others.
After reviewing the evidence, the grand jury concluded that Bard’s self-defense claim was credible and declined to move forward with charges.
