Hochul Signs Law Regulating Kratom Sales in New York

Governor Kathy Hochul signed new legislation in Albany, New York, aimed at regulating the sale of kratom, an herbal product linked to over 100 overdose deaths in the state last year. The new laws, signed on Monday (December 22), prohibit the sale of kratom to individuals under 21 and mandate warning labels on all kratom products, highlighting potential addiction and side effects.

Kratom, derived from the Mitragyna speciosa tree native to Southeast Asia, is often marketed as a natural supplement. However, it has opiate-like effects and can be addictive. Governor Hochul emphasized the importance of consumer awareness, stating, "If a product carries real risk, don't you think people should know about it?" Hochul's remarks highlighted the tragic loss of young New Yorkers, including Nick Scribner, who died from kratom intoxication in 2024.

The legislation, which includes fines of up to $500 for violations, aligns kratom regulations with those for tobacco, vaping products, cannabis, and alcohol. Newsday reports that the FDA and CDC have warned about kratom's addictive properties, especially its concentrated byproduct, 7-OH.

The bills, sponsored by Senator Pat Fahy, Senator James Skoufis, Assemblymember John McDonald, and Assemblymember Phil Steck, aim to prevent further tragedies and protect New Yorkers from the risks associated with kratom use. Hochul expressed hope that these measures will save lives and spare families from the pain of losing loved ones to kratom-related deaths.
