Florida Lawmakers Push Major HOA Reform As Homeowner Complaints Rise

FLORIDA - A new bill filed ahead of the upcoming legislative session seeks to overhaul rules governing homeowners associations and condominiums, following years of criticism from homeowners who say they have limited options when disputes arise.

Lawmakers say complaints about HOAs have steadily increased, often involving fines, rule enforcement, transparency and access to fair dispute resolution.

The proposal would remove the current requirement that homeowners attempt pre lawsuit mediation before taking legal action against an HOA.

Instead, disputes would be directed to a newly created court program focused specifically on community association cases.

Supporters argue this could lead to faster rulings and clearer legal outcomes, while reducing lengthy and costly legal processes.

Another provision would allow residents to begin the process of dissolving their HOA.

If at least 20 percent of homeowners sign a petition, the association would be required to hold a vote.

A two thirds majority would be needed to approve dissolution, which would then move to judicial review.

Lawmakers say the option would give homeowners leverage in communities where boards are unresponsive or mismanaged.

The bill also includes new requirements for associations to regularly update and maintain governing documents to improve transparency for residents.

Florida has more homeowners associations than any other state, with millions of residents living under HOA or condominium rules.

The legislation has been filed in the House and is expected to be reviewed during the next session.

Lawmakers have not yet announced whether a companion bill will be introduced in the Senate, which would be required for the proposal to advance further.
