Trump will win nearly all these court cases eventually

Jay Weber Show transcript 4-14-25

Trump will win nearly all these court cases eventually.

That’s the simple truth and the banner headline that needs to be put over this segment, too, after we got several more trump wins in court last weekend-

Including a judge admitting Trump and Rubio have the right to ‘make the call’ on who constitutes a national security threat and deport them-

This was the ‘win’ in court declaring that a terrorist-loving former Columbia student can be deported.

Then-on Friday-there was also a decision by a federal judge who ruled that religious organizations suing over ice arresting illegal aliens in or around churches was invalid- because none of those organizations had standing to sue.

Fantastic.

This judge basically said that the religious organizations couldn’t show him on they were ‘harmed’ in any way by these ice actions.

Now- ‘this could change’ – the judge suggested: maybe you can come back later with actual evidence of illegals being grabbed up out of the pews...or being driven from your services by ice agents mulling around outside-

But you didn’t provide any examples of that- yet this judge basically said. And if you can’t show how, you are ‘harmed’ by this executive order, you can’t sue.

So that’s a win- even as-

Even as- another lower court judge in Maine leapt on a grenade for her fellow leftists- and ordered the trump education department to restore federal funding that is being taken away from Maine k-12 schools because they refuse to ban boys from girls’ sports.

This is another one of those court fights that the lefties-and this lower court judge-are going to eventually lose.

So, the judge ordered the flow of federal funding for Maine’s school lunch program to resume-

But here’s the thing: he relied on a claim that trump’s team didn’t follow ‘procedure’...instead of claiming Trump didn’t have the right to enforce title nine laws.Because Trump does.

I’ve talked about this before: one ‘go-to’ move from these liberal judges is to step in and rule against a republican or conservative effort on procedural grounds. Because that allows them to completely ignore the ‘actual law’.

I’m guessing that this judge knows trump and his team are ‘entirely within the law’ and entirely within their rights to cancel this federal funding if Maine’s schools refuse to comply with a discrimination law and insist that-by God-we are going to continue to discriminate.

This judge knows Maine isn’t correct ‘on the merits of the case.

And so, he pulls this ‘procedural’ crap...about how Trump’s team ‘moved to fast’ to block this funding and didn’t ‘dot an i’...or ‘cross at’, procedurally.

Okay. But it doesn’t mean trump’s team won’t win on the ‘real fight’ eventually. Because they will.

In yet another example of this- we got a ruling from an appeals court on Friday that overturned a court order that blocked trump from dismantling Elizabeth Warren’s unconstitutional baby: the consumer financial protection bureau.

Trump moved to kill the agency off. The question over whether he can-isn’t a clear one for the courts-

He probably can’t, because congress created it-but- the appeals court on Friday basically ruled that Trump- can- starve it to death.

Squats with unions tried to create this agency outside the rules of the constitution...and say that the executive branch didn’t have the authority to manage the agency-as it does for all other agencies-

Trump’s team said ‘bull plop’...and fired staffers and cut its funding...which led to a lower court decision that trump-could not- shut down the CFBP and it had to rehire employees and leave it alone.

Well-on Friday- the appeals court said: no, the president-does-have the power to dismantle the CFPB to some extent:

And the labor unions who filed the lawsuit on behalf of fired workers can appeal this decision, too, but it sounds like - as we suspected: Trump’s team does have the right to fire staffers and/or slash budgets and ‘starve’ any agency that it feels it needs to- even if it’s an agency created by congress.

Trump and Linda McMahon plan to do a similar thing at the dept of education- if congress won’t vote to kill off that dept.

Byron Donald’s has introduced legislation to kill off the cfpb- but we’ll see where that goes. Dems will just filibuster the bill if they get a chance to-

But-it’s great to know trump and his team can ‘devalue’ this agency to the point that it’s basically useless and no longer harming the American people.

Oh-

Oh! And then there’s this move this is going to be great to watch.

I’ll tell you about it now in the simplest terms- and then we will watch it play out.

Folks-president trump quietly made a move last week that ordered all federal agencies to kill off any federal regulations that conflict with supreme court rulings.

That sounds logical, doesn’t it?

And it is- but it could lead to hundreds and hundreds of lawsuits- over time-as Trump’s minions do this...

And it represents a major effort to gut our regulatory state without having to go through the tedious, intricate, proper channels.

What i mean by that is: normally, to kill off a regulation, an administration needs to go thru a formal process. Make the declaration. Put out notices. Do official reviews. Gather public input...etc... etc.   And it can take months or years.

Well-

What trump did midweek last week- was quietly put out a sweeping directive to his agency heads saying: please do a thorough review and kill off any regulations that violate these ten supreme court rulings.

Then-he listed the ten supreme court rulings...including the one last year that ended the so-called ‘chevron rule’ that insisted any judge should ‘defer’ to the agency’s position on all sorts of things.

At the time of the ruling-we said: this could be huge: this was the supreme court saying entire categories of regulations were invalid because the agencies had overstepped their constitutional authorities.

We said- thousands of regulations could ‘fall’ if push ever came to shove.

Well- here’s trump ‘shoving’.

He’s saying, based on these supreme court decisions, we have all sorts of regulations that are illegal. Invalid. Unconstitutional. And so- find them and kill them off.

And-

And-very notably- right in the order, trump makes it clear- you don’t need to go thru the normal process- because they aren’t legal regulations. By definition-they are illegitimate and need to be separated out and snuffed out.

Well, you can imagine the uproar this is going to cause when ‘wider Washington’ and the left-wing activist groups discover this.

Already- politico is claiming that trump’s legal team is ‘misinterpreting’ the court decisions and issuing and illegal jihad against regulations here.    Our legal experts on the right claim he’s not. He’s simply pushing boundaries instead of allowing illegal regs to continue to exist.

But- this is going to lead to all sorts of lefty meltdowns and legal actions and courtroom fun.

That! Is what’s going to have the activist’s filing lawsuit after lawsuit- as they try to use that ‘condition’ to keep these regulations in place.

It’ll be a lot of claims that Trump doesn’t have ‘good cause’ to ignore the process. What’s his ‘good cause’?Judge...is this ‘good enough cause’...to ignore the will of the people? Etc.

The ‘conditional use’ of an exemption here is going to be the battleground on which- all these battles- will be fought.

So many Americans appreciating and loving Trump. Including myself. I don’t agree with everything he does- or the way he does it-

But this is the stuff that will make him a legend. Every other president....

And i sincerely mean every other president...

Has simply allowed illegal regulations to remain in place after important supreme court rulings have made it clear: this regulation is illegal.

Well, unless someone is going to specifically challenges it and sue over it-we are going to keep it in place. Right? Because they bias is always in favor of the regulatory state in dc. Correct?

No. Other. President would do this. Trump is proving, again, that he genuinely cares about this country, it’s people, and our freedoms...and saying...i want every unconstitutional or invalid regulation off the books. Find them. And erase them. And please do it without public notice. There’s no reason to give rabid activists and America haters a heads-up. Just quietly cancel them.

And it might be that last part that’s infuriating DC insiders the most: don’t even give the activists and haters a ‘heads up’. Just do it.

But Trump is right to play it this way: after all-if they are illegal regs they are illegal regs. We don’t need two years of nonsense to come to that-already clear- conclusion.
